Kure Health Inc. and its affiliates (referred to as "Kure Health," "the Company," "we," "us," or "our") provides health and wellness services, including primary care, regenerative medicine, wellness programs, telehealth consultations, and related health technology solutions. These Terms and Conditions ("Terms") govern your access to and use of kurehealth.io and any related websites, patient portals, mobile applications, and services (collectively, the "Site" and "Services").
BY ACCESSING OR USING THE SITE OR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS, OUR PRIVACY POLICY, AND OUR NOTICE OF PRIVACY PRACTICES (HIPAA). IF YOU DO NOT AGREE, DO NOT ACCESS OR USE THE SITE OR SERVICES.

1. Definitions
For purposes of these Terms:
"Patient" means any individual who receives or seeks to receive healthcare services from Kure Health, whether in-person, via telehealth, or through our wellness programs.
"Provider" means any licensed physician, nurse practitioner, physician assistant, registered nurse, or other healthcare professional employed by, contracted with, or affiliated with Kure Health.
"Protected Health Information" (PHI) means individually identifiable health information as defined under the Health Insurance Portability and Accountability Act of 1996 (HIPAA), including information transmitted or maintained electronically (ePHI).
"Services" means all healthcare, wellness, telehealth, health technology, and related services offered by Kure Health, whether delivered in person, remotely, or through the Site.
"Wellness Programs" means non-clinical health improvement programs, nutritional guidance, fitness programs, mental health resources, and preventive health education offered by Kure Health.
"Telehealth Services" means the delivery of healthcare services through telecommunications technology, including video consultations, remote patient monitoring, asynchronous messaging, and other virtual care modalities.

The content provided on this Site, including text, graphics, images, and information, is for general informational and educational purposes only. It is not intended to be and should not be interpreted as:
- A substitute for professional medical advice, diagnosis, or treatment
- A physician-patient relationship between you and Kure Health (unless you are an established patient)
- An endorsement of any specific test, physician, product, procedure, or opinion
- Medical advice for any specific individual or condition
The use of the Site does not create a provider-patient relationship. A provider-patient relationship is established only when you have been formally accepted as a patient and have completed the required intake, consent, and registration processes.
Information about health conditions, treatments, medications, and wellness approaches is provided for educational purposes. Individual results may vary, and no outcomes are guaranteed. Regenerative medicine, wellness programs, and other services described on this Site may not be appropriate for every individual.
Emergency Situations
This Site and our Services are not designed for medical emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency department immediately. Do not use the Site, patient portal, or telehealth platform to seek emergency medical care.
3. Eligibility & Patient Responsibilities
Eligibility
To use our Services, you must:
- Be at least 18 years of age, or have a parent or legal guardian consent on your behalf
- Provide accurate, complete, and current registration and health information
- Be located in a state where Kure Health and its Providers are licensed to practice (for telehealth services)
- Have the legal capacity to enter into these Terms
Patient Responsibilities
As a patient or user, you agree to:
- Provide accurate and complete health history, medication lists, allergies, and other relevant medical information
- Follow the treatment plans and recommendations of your Provider
- Inform your Provider of any changes to your health, medications, or conditions
- Keep scheduled appointments or cancel with reasonable notice
- Pay for Services in accordance with our billing policies
- Treat all staff and Providers with courtesy and respect
- Not engage in disruptive, threatening, or abusive behavior
4. Description of Services
Kure Health offers a range of health and wellness services, which may include but are not limited to:
Primary Care: Comprehensive primary healthcare services including annual wellness exams, acute care visits, chronic disease management, preventive screenings, and health assessments.
Regenerative Medicine: Advanced regenerative therapies, including but not limited to PRP therapy, stem cell treatments, and other evidence-based regenerative approaches. Results vary by individual and are not guaranteed.
Wellness Programs: Integrated wellness programs including nutritional counseling, fitness guidance, stress management, mental health resources, and preventive health education.
Health Technology: Digital health tools, remote patient monitoring, health tracking, and AI-assisted health insights to support your care journey.
Telehealth: Virtual consultations, remote monitoring, and digital communications with Providers via our secure telehealth platform.
The availability of specific Services may vary by location, Provider availability, and applicable state and federal regulations. We reserve the right to modify, discontinue, or limit any Services at any time.
5. Telehealth & Virtual Care
Telehealth Informed Consent
By using our Telehealth Services, you acknowledge and agree that:
- Telehealth involves the use of electronic communications to deliver healthcare services at a distance
- Telehealth has potential benefits (convenience, reduced travel) and limitations (inability to perform physical examinations, potential technology failures)
- The Provider may determine that telehealth is not appropriate for your condition and may refer you for in-person care
- There are potential risks including delays in evaluation and treatment due to technology failures, and security risks despite reasonable safeguards
- You have the right to withdraw consent to telehealth services at any time
- All laws protecting the confidentiality of your medical information apply to telehealth interactions
Technical Requirements
You are responsible for ensuring you have adequate internet connectivity, a compatible device, and a private environment for telehealth consultations. Kure Health is not responsible for interruptions or quality issues caused by your equipment or internet connection.
Geographic Limitations
Telehealth Services are available only in states where our Providers are licensed to practice medicine. You must be physically located in a state where our Providers are authorized to deliver care at the time of your telehealth visit. You agree to accurately represent your physical location during any telehealth interaction.
6. Patient Portal & Accounts
Account Registration
If you create a patient portal account, you agree to:
- Provide accurate, current, and complete registration information
- Maintain and promptly update your account information, including health information
- Maintain the security and confidentiality of your login credentials
- Accept responsibility for all activities that occur under your account
- Immediately notify us of any unauthorized use of your account
- Not share your credentials with any other person
Account Security & HIPAA
Your patient portal may contain Protected Health Information. You are responsible for maintaining the confidentiality of your login credentials and for ensuring that unauthorized persons cannot access your account. We implement HIPAA-compliant security measures to protect your information, but we cannot guarantee the security of information you transmit over the internet.
Electronic Communications
By creating an account, you consent to receive healthcare-related communications electronically, including appointment reminders, test results, care plan updates, billing notifications, and health education materials. You may opt out of non-essential communications at any time, but certain clinical communications are necessary for your care and cannot be disabled while you are an active patient.
7. HIPAA & Health Information
Your Rights Under HIPAA
As a patient, you have rights under the Health Insurance Portability and Accountability Act (HIPAA) regarding your Protected Health Information, including the right to:
- Access and obtain a copy of your medical records
- Request amendments to your health information
- Receive an accounting of disclosures of your PHI
- Request restrictions on certain uses and disclosures
- Request confidential communications
- File a complaint if you believe your privacy rights have been violated
Notice of Privacy Practices
Our Notice of Privacy Practices describes how we may use and disclose your PHI and your rights regarding that information. By using our Services, you acknowledge receipt of our Notice of Privacy Practices, which is available on our Site and at our physical locations.
HITECH Act Compliance
We comply with the Health Information Technology for Economic and Clinical Health (HITECH) Act, which strengthens HIPAA protections. This includes providing breach notification in the event of a breach of unsecured PHI and ensuring our business associates comply with applicable HIPAA requirements.
De-Identified & Aggregate Data
We may use de-identified or aggregate health data (data that cannot reasonably identify you) for research, quality improvement, public health reporting, and business analytics purposes. Such use is permitted under HIPAA and does not require your authorization.
8. Informed Consent
Before receiving clinical services, you will be asked to provide informed consent, which may include:
- A description of the proposed treatment or procedure
- The expected benefits and potential risks
- Alternative treatments, including the option of no treatment
- The right to refuse or withdraw consent at any time
- Any costs associated with the treatment that may not be covered by insurance
For certain services, particularly regenerative medicine procedures, you may be required to sign additional consent forms. Your Provider will discuss the specifics of each treatment with you before proceeding.
Right to Refuse Treatment
You have the right to refuse any treatment or procedure at any time. If you choose to refuse a recommended treatment, your Provider will explain the potential consequences. Your refusal will be documented in your medical record.
9. Payment, Insurance & Billing
Patient Financial Responsibility
You are responsible for all charges related to your care, including copayments, deductibles, coinsurance, and any services not covered by your insurance plan. Payment is due at the time of service unless other arrangements have been made.
Insurance
While we may submit claims to your insurance provider as a courtesy, insurance coverage is a contract between you and your insurer. We are not responsible for determining your coverage or benefits. You are responsible for understanding your plan and any out-of-pocket costs. Some services, particularly wellness programs and certain regenerative medicine treatments, may not be covered by insurance.
Surprise Billing Protections
In accordance with the No Surprises Act and applicable state laws, we will provide you with a good faith estimate of expected charges for scheduled services when requested and as required by law. You have the right to receive a good faith estimate for the total expected cost of any non-emergency healthcare service.
Collections
Unpaid balances may be referred to a collection agency after reasonable attempts to collect from you. You agree to pay reasonable collection costs and attorney fees incurred in collecting unpaid amounts.
10. Intellectual Property
Ownership
The Site and all content, features, and functionality thereof, including but not limited to text, graphics, logos, images, health education materials, software, and design, are owned by Kure Health Inc., its licensors, or other providers and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
Trademarks
"Kure Health," and all related names, logos, product and service names, designs, and slogans are trademarks of Kure Health Inc. or its affiliates. You may not use such marks without our prior written permission.
Limited License
We grant you a limited, non-exclusive, non-transferable license to access and use the Site for your personal, non-commercial healthcare purposes. You may not reproduce, distribute, modify, display, or create derivative works from any content on the Site without our prior written consent, except that you may print or download health education materials for your personal use.
11. Prohibited Activities
You agree not to:
- Use the Site or Services for any unlawful purpose
- Provide false or misleading health information to your Provider
- Misrepresent your identity or your location when accessing Telehealth Services
- Attempt to obtain prescription medications or controlled substances through deception
- Access or attempt to access another patient's health information or account
- Interfere with or disrupt the Site, patient portal, or telehealth platform
- Use any automated means to access the Site or extract data
- Use content from the Site to provide or represent yourself as providing medical advice
- Record telehealth sessions without the express consent of all parties
- Engage in threatening, abusive, or disruptive behavior toward staff or Providers
12. Third-Party Links & Services
The Site may contain links to third-party websites, including health information resources, insurance providers, pharmacies, and laboratory services. We provide these links for your convenience only and do not endorse or assume responsibility for their content, privacy policies, or practices.
We may refer you to third-party healthcare providers, specialists, laboratories, or other health services. Such referrals do not constitute an endorsement, and you should independently evaluate any third-party provider.
13. Disclaimer of Warranties
THE SITE AND ANY INFORMATIONAL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
TO THE FULLEST EXTENT PERMITTED BY LAW, KURE HEALTH DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, WITH RESPECT TO THE SITE AND INFORMATIONAL CONTENT.
THIS DISCLAIMER DOES NOT APPLY TO THE PROFESSIONAL HEALTHCARE SERVICES PROVIDED BY OUR LICENSED PROVIDERS, WHICH ARE GOVERNED BY APPLICABLE MEDICAL PRACTICE STANDARDS, STATE LAW, AND PROFESSIONAL LICENSING REQUIREMENTS.
KURE HEALTH DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT GUARANTEE ANY SPECIFIC HEALTH OUTCOMES FROM USE OF OUR SERVICES.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KURE HEALTH, KURE HEALTH INC., OR ANY OF THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, PROVIDERS, AFFILIATES, AGENTS, OR REPRESENTATIVES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE (AS DISTINCT FROM CLINICAL SERVICES).
THIS LIMITATION OF LIABILITY DOES NOT APPLY TO CLAIMS OF MEDICAL MALPRACTICE, PROFESSIONAL NEGLIGENCE, OR OTHER CLAIMS ARISING FROM THE DIRECT PROVISION OF HEALTHCARE SERVICES BY OUR LICENSED PROVIDERS, WHICH ARE GOVERNED BY APPLICABLE STATE LAW.
NOTHING IN THESE TERMS SHALL LIMIT OR EXCLUDE LIABILITY FOR FRAUD, GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR ANY LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
15. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Kure Health, Kure Health Inc., and their respective directors, officers, employees, Providers, affiliates, and agents from and against any claims, liabilities, damages, costs, and expenses arising out of:
- Your misuse of the Site or Services
- Your violation of these Terms or any applicable law
- Your provision of false or misleading health information
- Your misrepresentation of your identity or location for Telehealth Services
- Unauthorized access to your account due to your failure to protect your credentials
16. Dispute Resolution
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Informal Resolution
Before initiating any formal dispute resolution process, you agree to contact us first and attempt to resolve any dispute informally. Most concerns can be resolved through our patient advocacy team.
Arbitration
Any dispute arising out of or relating to these Terms or your use of the Site (excluding medical malpractice claims, which are governed by applicable state law) shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall be held in Miami, Florida.
Exceptions
This arbitration provision does not apply to: (a) claims of medical malpractice or professional negligence; (b) claims that may be brought in small claims court; (c) claims for equitable relief for intellectual property infringement; or (d) any claims where arbitration is prohibited by applicable law.
Class Action Waiver
TO THE EXTENT PERMITTED BY LAW, YOU AND KURE HEALTH AGREE THAT ANY ARBITRATION OR COURT PROCEEDING SHALL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws provisions. To the extent any dispute is permitted to proceed in court, you submit to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida.
Healthcare services provided by Kure Health are subject to the laws and regulations of the state in which they are delivered, including state medical practice acts, HIPAA, the HITECH Act, and other applicable federal and state healthcare regulations.
18. General Provisions
Entire Agreement
These Terms, together with our Privacy Policy, Notice of Privacy Practices, and any consent forms you sign, constitute the entire agreement between you and Kure Health regarding the Site and supersede all prior communications.
Severability
If any provision of these Terms is found to be unenforceable, that provision shall be modified to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
Waiver
The failure of Kure Health to exercise any right under these Terms shall not constitute a waiver of such right.
Assignment
You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
Force Majeure
Neither party shall be liable for failure to perform due to causes beyond reasonable control, including natural disasters, pandemics, government actions, or failures of third-party systems.
Electronic Signatures
You agree that electronic signatures and acceptances, including those for consent forms and patient agreements, are legally binding in compliance with the ESIGN Act and UETA.
Notices
All notices under these Terms shall be in writing. Notices to you may be sent via email or through the patient portal. Notices to us should be sent to info@kurehealth.io.
19. Changes to These Terms
We reserve the right to modify these Terms at any time. Material changes will be posted on the Site with an updated "Last Updated" date. We may also notify you through the patient portal or by email.
Your continued use of the Site or Services after modified Terms have been posted constitutes your acceptance. If you do not agree, you must discontinue use of the Site and Services.
